There are two aspects which a prosecutor must prove beyond a reasonable doubt in order to secure a conviction. First, it must be demonstrated that an individual intended to commit the act of murder, however, proving intent can be tremendously complex. In California, the punishments associated with attempted murder are dependent on the “degree” of the crime. First-degree attempted murder is punishable by life in prison with the possibility of parole. Crimes of the second degree are punishable by up to nine years in prison. Penalties can also increase depending on factors such as a defendant’s past criminal history as well as who the crime was committed against. For example, acts of violence taken against law enforcement can have harsh minimum sentences.
