Elements of Attempted Murder
There are two aspects which a prosecutor must prove beyond a reasonable doubt in order to secure a conviction. First, it must be demonstrated that an individual intended to commit the act of murder, however, proving intent can be tremendously complex. For example, the prosecution must show that an attempt was made to kill another person and not to just cause injure them. In addition, the defendant must have taken action towards a murder, threats alone are not enough. While each case is unique, possible examples of a direct action can include firing a gun at a person or swinging a bat at a person's head.
Charges and Punishments
In California, the punishments associated with attempted murder are dependent on the “degree” of the crime. First-degree attempted murder is punishable by life in prison with the possibility of parole. Crimes of the second degree are punishable by up to nine years in prison. Penalties can also increase depending on factors such as a defendant's past criminal history as well as who the crime was committed against. For example, acts of violence taken against law enforcement can have harsh minimum sentences.
Additional penalties for attempted murder can include:
- Fines of up to $10,000
- A “strike” on your criminal record
- Inability to own a firearm
